The series consists of records gathered or created by Feit prior to the period in which the JBNQA was actively negotiated.
In 1972, Eeyou (Cree) and Inuit peoples in Northern Québec sought an injunction to block the James Bay hydroelectric project which had been initiated by the Québec government in 1971 in direct contravention of Eeyou and Inuit peoples’ occupation of and rights to the territory proposed for development. Until 1974, the Indians of Québec Association’s (IQA’s) James Bay Task Force and other experts, lawyers, journalists, film makers, and social and environmental activists assisted Eeyou and Inuit peoples in pursuing legal challenges to the project and negotiating a treaty with the federal and provincial government. Feit, a social scientist, supported Eeyou people and leaders, particularly in the initial court case against the James Bay project (Chief Robert Kanatewat et al. vs. JBDC, JBEC et al. in Québec Superior Court, 1973). Feit’s activities included advising on social science witnesses and testimonies for the case, preparing commentaries and critiques of government data, writing various reports on James Bay Eeyou people’s land and wildlife use, and critiquing hydroelectric and forestry development plans and impact assessments. In 1973, Feit served as expert witness in the abovementioned case, testifying twice about Eeyou peoples’ land use, particularly hunting.
Records in the series are arranged in their received order. Documentary forms include academic papers and James Bay Development Corporation publications collected by Feit; reports and correspondence from the IQA Task Force; minutes of meetings with Environment Canada, the IQA, Cree leaders and consultants, and the Northern Québec Inuit Association (NQIA); and transcripts of witness testimonies in Kanatewat et al. vs. JBDC, JBEC et al. (Québec Superior Court, 1973).

Series 2
JBNQA Creation and Negotiation. – 1965-1986, predominant 1974-1976. – 2.13 m of textual records.
The series comprises records related to the negotiation and creation of the JBNQA. In April 1974, the IQA ceased to represent Eeyou peoples in treaty negotiations with federal and provincial governments. By August of this year, Eeyou peoples had formed the Grand Council of the Crees of Québec (GCCQ), which was to take up the mandate formerly held by the IQA. From 1974-1982, and thus during the period in which the JBNQA was negotiated and signed (late 1973 to 1975), Feit assisted the GCCQ and related Eeyou bodies on a number of aspects of the JBNQA and related projects.
Feit’s specific focus during the period of negotiation was on the following areas of the JBNQA: hunting, fishing, and trapping (section 24); the income security program for Eeyou hunters and trappers (section 30); economic and social development provisions for Eeyou peoples (section 28); environmental and future development provisions (section 22); and technical aspects, specifically hydroelectric project modification provisions (section 8). The series features records related to Feit’s work with the GCCQ, the Cree Regional Authority (formed in 1978 and now called the Cree Nation Government), and related entities from the signing of the JBNQA (November 1975) until 1987. During this time, Feit worked with the following organizations:

The GCCQ appointed Feit to this committee, on which he served as founding chair and member.
- 1975-1978—Hunting, Fishing, and Trapping Coordinating Committee for James Bay and Northern Québec (HFTCC): This committee, established by section 24 of the JBNQA, included members and representatives of Indigenous governments and organizations, as well as the Canadian federal and Québec governments. Its primary function was to review and manage the Hunting, Fishing, and Trapping Regime established by the JBNQA. Feit occasionally sat as a member on this committee and its working groups.
- 1976-1977—Cree Hunters and Trappers Income Security Board: This board, established by section 30 of the JBNQA, included members from the Cree Regional Authority and the Government of Québec. The Board administered the income security program for Eeyou hunters and trappers. Feit assisted in the startup of the board and some future adaptations of the program to suit Eeyou peoples’ needs.
- 1976-1986—James Bay Environmental and Social Impact regimes: Feit served as an Eeyou-appointed member of various joint Indigenous, provincial, and federal committees that sought to implement JBNQA regimes. Feit reviewed the adequacy of impact statements for various projects, including community relocations, mines, airports, highways, transmission lines, and access roads.
- 1983-1986—Task Force on Guaranteed Harvest Level Allocations: The task force was established by the Hunting, Fishing, and Trapping Coordinating Committee. Its remit was to ensure agreement amongst all governments regarding guaranteed game harvest allocation levels for Eeyou and Inuit hunters. Feit was an Eeyou-appointed member of this Task Force.
- 1987—Comite de la Baie James sur le Mercure: The Committee included members representing Eeyou peoples, the government of Québec, and Hydro-Québec. Its goal was to implement the Mercury Agreement created between the aforementioned parties in 1986. Feit contributed a report to the committee on the potential impacts of remedial programs to deal with methylmercury contamination in fish harvested and consumed by Eeyou peoples in James Bay. Increased methylmercury levels in fish were in part the result of the creation of hydroelectric reservoirs in the region.
Additionally, the series includes records related to Feit’s community-based research projects from 1972-1983. Feit undertook many of these projects for Eeyou peoples and government. Projects include:
- James Bay and Northern Québec Native Harvesting Research: This research, conducted by the James Bay and Northern Québec Native Harvesting Research Committee, was initiated during the second year of negotiation of the JBNQA (1975) to fulfill the guaranteed game harvest allocation protections for Eeyou and Inuit peoples as specified in the 1974 agreement in principle (AIP). The research project came to be under the auspices of the Hunting, Fishing, and Trapping Coordinating Committee for James Bay and Northern Québec in 1975. The project relied upon survey questionnaire data and diary-based research on wildlife harvesting by James Bay Eeyou peoples from 1972-1979. It employed local administrative and research staff in eight James Bay Eeyou communities and Montréal over a five-year period; it also featured a separate research program in Northern Québec Inuit communities. Its total budget of $1,016,000 was funded by the federal and provincial government, GCCQ, NQIA, Hydro-Québec, the James Bay Energy Corporation, and the James Bay Development Corporation. The first report of findings was published in 1976; final reports on Eeyou research were published in 1982 and 1983. Feit wrote a separate and independent report-commentary on this research in 1980.
- Land use, occupancy, and social impact studies: Various studies were conducted by Eeyou First Nations in Mistissini, Eastmain, Wemindji, and Waswanipi between August 1973 and December 1978 in order to aid Eeyou negotiators in identifying land areas for selection and special protection provisions. These interview and mapping projects were coordinated by Harvey Feit and/or Alan Penn and local teams. The studies’ total budget of $100,000 was provided by Eeyou organizations.
- Fort George Land Use and Subsistence Economy Study: This study was conducted from 1973-1976. Initially it was undertaken for the Indians of Québec Association, but was taken over by the GCCQ. Research was directed by Martin Weinstein in Fort George [Chisasibi] with local researchers. Harvey Feit provided support in Montréal and Ottawa. The study was designed to indicate the geographical distribution and intensity of Eeyou wildlife harvests in Chisasibi, especially with relation to the planned development of the La Grande River hydroelectric complex. The study responded to claims at the time by the province of Québec and Hydro-Québec which minimized the uses by Eeyou peoples of lands that would be flooded or otherwise impacted by development. Research funding, which came from the Indians of Québec Association and the GCCQ, amounted to $82,540. Preliminary reports of findings were released in 1974 and 1975 by Feit and Weinstein, respectively; in 1976, a comprehensive final report was published by Weinstein.
- Studies of the Cree Hunters and Trappers Income Security Program: These studies used interview, survey, and government data to document and analyze the workings and initial effects of the income security program in seven Eeyou communities from September 1976-December 1982. Harvey Feit and Colin Scott were co-researchers on the project, with local research staff in northern villages and government offices. The final report was addressed to Cree and other governments desirous of improving the program, and to governments outside of Québec interested in implementing a similar program. Studies were funded by the Québec Ministère des Affaires Sociales (MAS), Comité de la Recherché Socio-économique, Eeyou organizations, McGill University, and scholarships to Colin Scott. MAS grants totaled $30,500. Interim reports were prepared in 1978 and 1979 by Colin Scott; a final report was published by Scott and Feit in 1992.

The series consists of Feit’s files related to the legal claims of non-Eeyou Indigenous peoples, particularly in Canada.
